Acceptance

These Terms of Use are a binding agreement between you and Waitkevich Ventures LLC, the operator of StaQ.health. By creating an account or using StaQ.health you accept these Terms. If you do not agree, do not use the app.

What StaQ is — and is not

StaQ is a personal tracking tool. It is not medical advice, not a medical device, not clinical software, and not a substitute for your doctor, pharmacist, or other qualified provider.

The numbers StaQ shows — active mg, steady-state estimates, blood-concentration estimates, receptor activation — are personal estimates based on simplified models. They are not clinical measurements and may be inaccurate.

No medical advice; no dosing decisions

Never start, stop, or change a medication or dose based on what StaQ shows without first consulting your prescriber. In an emergency, call your local emergency number.

Your responsibility; assumption of risk

StaQ displays information derived from data you enter. You are solely responsible for the accuracy and completeness of that data; incorrect inputs produce incorrect estimates. You are also responsible for safeguarding your account credentials and for all activity under your account.

YOU — NOT WAITKEVICH VENTURES LLC — ARE SOLELY RESPONSIBLE FOR YOUR HEALTH DECISIONS AND FOR ANY ACTION YOU TAKE, OR DECLINE TO TAKE, BASED ON INFORMATION DISPLAYED BY STAQ. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE APP.

Eligibility

You must be at least 18 years old and able to form a binding agreement.

Acceptable use

Do not misuse the app: no illegal use, no attempts to breach or probe security, and no use on behalf of another person without their consent.

Accounts

You are responsible for activity under your account. Sign-in is handled by Clerk.

Beta software

StaQ is in early beta. Features may break or change and data could be lost. Keep your own records of anything important.

Disclaimer of warranties

STAQ IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WAITKEVICH VENTURES LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL NOT BE LOST.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAITKEVICH VENTURES LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROFITS, OR ANY HEALTH OUTCOME, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF WAITKEVICH VENTURES LLC FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR FIFTY U.S. DOLLARS ($50).

Indemnification

You agree to defend, indemnify, and hold harmless Waitkevich Ventures LLC and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the app, the data you enter, your violation of these Terms, or your violation of the rights of any third party.

Changes and termination

We may modify or discontinue the app or these Terms at any time. Continued use after a change means you accept it. We may suspend or terminate your access at any time, including for violation of these Terms. You may stop using the app and request deletion of your data at any time.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. The state and federal courts located in Washington have exclusive jurisdiction over any dispute relating to these Terms or the app, and you consent to personal jurisdiction and venue in those courts.

Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. A failure to enforce a provision is not a waiver of it. You may not assign these Terms; Waitkevich Ventures LLC may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Waitkevich Ventures LLC regarding the app.
